Tenancy Deposit Scheme

The Tenancy Deposit Scheme in Scotland came into force on the 2nd July 2012. This is an important piece of new legislation which all landlords must be aware of.

To date, all tenant's deposits have been held by Rettie & Co in our fully regulated, separate deposit account governed by the RICS client money handling regulations. Rettie & Co are one of only a minority of letting agents in Scotland who are regulated by the RICS. The new scheme requires that all deposits from now on (subject to a phase-in period up until May 2013) are held by one of three government backed deposit schemes and there is a detailed process for the pay-in and retrieval of these monies at the beginning and end of the lease respectively.

A second element to this scheme is a dispute resolution service provided in the event of disagreements over the deposit return after check out.
